Subscription Policy

Gun Sense for Kids uses a unique subscription policy that differs from other subscription and streaming services. Our model employs an open subscription model. This policy outlines the terms and conditions for subscription use.

1. Open Subscription Model

Our open subscription model is designed to make the curriculum as accessible as possible to users, including both students as well as parents, teachers, administrators, and others. After subscribing, subscribers are provided with a set of access options, such as a unique launch link, a QR code sheet, or embed codes.

Gun Sense for Kids employs limited anti-abuse measures, such as preventing repeated launches from the same browser session within short timeframes. However, subscribers are ultimately responsible for all launches made using their credentials or launch link.

It’s important that subscribers maintain control of their access tools if they intend to limit access. However, Gun Sense for Kids makes no restriction on how subscribers use their access options. For example, posting the curriculum in an embedded window on a school’s public webpage is by all means allowed by Gun Sense for Kids, but could lead to unauthorized access.

2. Billing Methods

Depending on the subscription plan, one of the following billing methods will apply:

  1. Up-Front Access Fee (Most Common):
Subscribers pay a fixed fee for access to the selected Gun Sense for Kids curriculum. Access will be subject to predefined limits, including duration, number of launches, or both.
  2. Pay-As-You-Go (Institutional Use Only):
Institutional subscribers may opt for pay-as-you-go billing. This model may not include specific access limitations but carries the following terms:
    • Internal Use Only is Suggested: The subscriber is responsible for ensuring that their launch link is not shared externally unless such sharing is acceptable under their billing terms, and understands that openly shared access could result in higher use rates and higher costs. (While we allow any degree of sharing by any type of subscriber, we suggest more strongly to pay-as-you-go subscribers that they not allow their subscription to be used externally.)
    • Billing Cycles: Billing occurs monthly unless otherwise agreed.
    • Sponsor Subsidies: If a subscription is subsidized by a sponsor, the availability of sponsor funds is not guaranteed and may run out during the subscription period.

3. Subscription Terms

  • Launch Limits and Periods of Access:
Subscriptions are limited to the number of launches and/or subscription periods specified at the time of purchase. Unused launches do not carry over unless explicitly stated in the subscription terms.
  • Refunds and Cancellations:
All subscription fees are non-refundable unless required by applicable law. Subscribers should carefully review their plan details before purchase. In cases of billing errors, subscribers should contact Gun Sense for Kids for resolution within 14 days of the charge.
  • Changes to Subscriptions:
Subscribers may not modify their subscription limitations once purchased. Upgrades or renewals must be made as new purchases.

4. Termination of Access

Gun Sense for Kids reserves the right to terminate access to the curriculum without refund if a subscriber violates this policy, including but not limited to:

  • Sharing credentials or launch links in such a way that abusive access is encouraged.
  • Engaging in fraudulent or abusive activities.
  • Non-payment of fees in the case of pay-as-you-go billing.

5. Limitation of Liability

Gun Sense for Kids provides the curriculum “as is” and makes no guarantees regarding the performance, availability, or results obtained through its use. To the fullest extent permitted by law, Gun Sense for Kids is not liable for damages arising from:

  • Unauthorized access or misuse of subscription credentials or launch links.
  • Interruption or unavailability of services.
  • Loss of access due to non-payment or abuse.
  • Failure of subscribers to support the curriculum in-person with additional practice and recall opportunities.
  • Failure of parents and others to store firearms properly.

Specifically: This curriculum was created with the intention to reduce, as much as possible, the risk of accidental injury due to the misuse of a firearm by or in the vicinity of a student who has completed the curriculum. While we believe behavioral training of children with respect to guns is critically important, we cannot guarantee the behavior of any individual child based on exposure to some or all of the curriculum.

6. Dispute Resolution

In the event of a dispute regarding subscription use or charges, subscribers agree to first contact Gun Sense for Kids to resolve the matter informally. If a resolution cannot be reached, disputes will be governed by the laws of the state of Montana, and disputes must be brought in a court within that jurisdiction.

7. Amendments to This Policy

Gun Sense for Kids reserves the right to amend this Subscription Policy at any time. Subscribers will be notified of significant changes via email or website notification, and continued use of the subscription constitutes acceptance of the revised terms.

8. Reproduction of Copyrighted Materials
